Welcome to use the products and services provided by us (i.e., the Dami service provider, "we" or "us"). This Service Agreement applies to various products and services we provide to you through websites, software clients, and new forms that emerge with technological development.
Please carefully read and fully understand all terms of this Agreement, especially the clauses that exclude or limit liability, and then choose whether to accept them. Limitation and disclaimer clauses may be presented in bold to draw your attention. Unless you have read and accepted all terms of this Agreement, please do not download, install, or use this software or related services. Your clicking to agree, downloading, installing, using, logging in, or any similar act will be deemed as your acceptance of the terms of this Agreement.
Your legal agreement to these terms constitutes binding rules (the "Terms"). You also agree to our Privacy Policy, Cookie Policy, Payment Verification Policy, and acknowledge that you are responsible for complying with any applicable local laws. Our Privacy Policy, Payment Policy, and other policies form part of this Agreement. We may change these Terms from time to time. If we do so, we will notify you of any material changes by posting on our website or sending you an email. New versions of these Terms will not apply retroactively. We will inform you of the exact effective date of the new version, which will be listed at the beginning of this Agreement upon release. If you continue to use the Dami software and services after the changes, you accept the new Terms. We reserve any and all rights not expressly granted by this Agreement, including but not limited to any and all rights to the system.
Violation of any term of this Agreement will result in termination of your account. You agree that you use the Dami software and services at your own risk.
If you have signed and accepted a service‑related agreement with us (the "Offline Agreement") before or after signing this Agreement, and such Offline Agreement remains valid, in the event of any conflict between the Offline Agreement and this Agreement, the Offline Agreement shall prevail. Matters not covered by the Offline Agreement shall be governed by this Agreement.
1. Account Terms
You must be at least 18 years old to register a Dami account, or your age must be sufficient to enter into a binding contract in your place of residence. If you are under 18, you may not use Dami products without the consent of a parent or guardian (who agrees on your behalf that you will comply with the Terms of Service).
You need to register to use Dami, select an account name, and set a password. Your information will be collected and disclosed in accordance with applicable data protection laws and our Privacy Policy. All users must provide true and accurate information when registering for our website or services. Do not use invalid or someone else's email address.
We reserve the right to verify all user information and to refuse any user. You are responsible for all activity in your account and for keeping your password confidential. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. Dami shall not be liable for any loss you incur as a result of someone else using your password or account, with or without your knowledge.
You may not use Dami software and services for any illegal or unauthorized purpose. When using the software, you shall not violate any laws (including but not limited to copyright laws) or other applicable legal provisions of your jurisdiction.
A Dami account is for the exclusive use of the user who registered it on the Dami website. Gifting, lending, renting, transferring, or selling the account is prohibited. If we find or have reason to suspect that the user is not the original registrant of the account, we have the right to suspend or terminate the provision of services to the user without notice, and to cancel the account, without incurring any legal liability to the account user. Any losses resulting therefrom, including but not limited to interruption of user communications, deletion of user data and information, etc., shall be borne solely by the user.
You agree that Dami may, in the course of providing services, send you advertisements, promotions, or marketing information (including commercial and non-commercial information) via SMS, email, electronic message, or other means, either by itself or through third-party advertisers. You agree that you shall carefully judge the truthfulness and reliability of any advertising information appearing in the Dami services, and unless expressly provided otherwise by law, you shall be responsible for any transactions conducted based on such advertising information. You agree that Dami may, in the course of providing services, report influencer information and connection records (such as invitations and direct messages) obtained through your store. You agree that Dami may aggregate the obtained influencer information into a comprehensive influencer database and use such comprehensive influencer database for feature development.
2. Prohibited Conduct
You shall comply with all applicable laws and regulations and shall not use Dami's services or account to engage in, or facilitate, any of the following conduct:
(1) Endangering national security, disclosing state secrets, subverting state power, undermining national unity, or harming national honor and interests;
(2) Promoting cults, feudalism, or superstition;
(3) Spreading rumors, disrupting social order, or undermining social stability;
(4) Disseminating obscene, pornographic, gambling, violent, murderous, terroristic, harassing, vulgar, or crime‑inciting material;
(5) Insulting or defaming others, or infringing upon the lawful rights and interests of others;
(6) Infringing upon others' intellectual property rights, trade secrets, or other lawful rights;
(7) Using this software to fabricate facts, conceal the truth, or mislead or deceive others;
(8) Engaging in illegal internet activities such as lottery or gambling games;
(9) Deleting or altering any rights management electronic information on this software;
(10) Intentionally circumventing or destroying technical measures adopted by copyright owners to protect the copyright of this software;
(11) Deleting, modifying, adding, or interfering with the functions of a computer information system in violation of state regulations, causing the computer information system to malfunction;
(12) Accessing a computer information network or using computer information network resources without authorization;
(13) Deleting, modifying, or adding functions of a computer information network without authorization;
(14) Deleting, modifying, or adding data or applications stored, processed, or transmitted in a computer information network without authorization;
(15) Disrupting the normal operation of this software system or website, or intentionally spreading computer viruses or other destructive programs;
(16) Engaging in any form of reselling of Dami products or sub‑accounts under sub‑users authorized by Dami;
(17) Any other conduct that endangers computer information network security.
(18) Any other conduct prohibited by public order, good customs, or laws and regulations.
You undertake that you will not use any type of software or device (whether manual or automatic) to "crawl" or "spider" any part of Dami, nor will you disassemble or reverse engineer any content of Dami.
You understand and agree that if you engage in any prohibited conduct under this Agreement, or use Dami software and services for any illegal or unauthorized purpose, or otherwise violate this Agreement, Dami has the right, in its reasonable discretion, to take action against conduct that violates applicable laws and regulations or this Agreement, to take appropriate legal action against any user who violates laws or this Agreement, and to preserve relevant information and report to relevant authorities in accordance with laws and regulations. You shall bear all legal liability arising therefrom.
You understand and agree that if your violation of this Agreement or any related terms of service results in or gives rise to any claim, demand, or loss asserted by a third party, you shall bear such liability independently. If Dami suffers any loss as a result, you shall also compensate Dami for such loss. If Dami is held liable in the first instance by a final judgment, ruling, or the like, Dami shall have the right to recover the full amount from you.
3. Fee Terms
Please visit our Payment Policy page to understand the pricing of all our services and the latest offers. Certain features of Dami are free, while others require payment. If you agree to our Payment Policy and subscribe to relevant features, you undertake to pay the fees for such features. The prices of all services (including but not limited to monthly subscription plan fees for the software) are subject to change.
We reserve the right to change or terminate the service (or any part thereof) at any time, with or without notice. Dami shall not be liable to you or any third party for any modification, price change, suspension, or termination of the service.
When a user subscribes to a paid membership through a specific method, they must read and confirm the relevant user agreement and usage instructions.
4. Refund Policy
No refunds are provided for any paid services of Dami. Please note that all payments are final.
After becoming a paid member, the member has the right to decline products or services from Mengla Technology and may apply to cancel the membership service, but will not receive any refund of service fees.
5. Termination of Agreement
This Agreement will take effect on the date you accept these Terms of Use and will remain in effect for a long term until terminated by either party. Dami has the right to suspend or terminate your account or service at any time for any reason, which may result in your account being disabled or deleted, or your access to the account being restricted, and all content in the account being deleted or cleared, without any liability for compensation on the part of Dami. Dami reserves the right to refuse service to anyone at any time for any reason.
You may contact us at any time through our official customer service. Please note that after termination of your account, access to certain parts of our website or services may be immediately prohibited. We have the right to terminate this Agreement with you under the following circumstances:
You violate any applicable law when using our website or services;
You violate this Agreement or the terms of the website or services;
We believe that any of your actions legally harm our business interests.
6. Intellectual Property
All content, designs, text, graphics, charts, images, logos, buttons, icons, interfaces, audio and video in the Dami website or products, and all combinations and arrangements thereof, are the exclusive property of Dami or its respective content providers and are protected by applicable copyright laws. All software used on the website is the property of Dami or its respective software suppliers and is protected by applicable copyright laws and other relevant laws and treaties. Website users shall not send or upload any content that infringes upon the copyright or other intellectual property rights of others to this website.
All trademarks, service marks, and trade names (collectively, the "Marks") used in the Dami website or products are owned exclusively by Dami. Such Marks shall not be used in connection with any product or service that is not a Dami product or service, or in any other product or service that causes consumer confusion, or that disparages or discredits Dami's reputation in any way.
7. Confidentiality and Feedback
We value your privacy. Our Privacy Policy is incorporated into this Agreement. Please review our Privacy Policy so that you may understand our privacy practices. All information we collect is subject to our Privacy Policy. By using the website or services, you agree to all actions we take with respect to your information in accordance with our Privacy Policy.
You agree to keep confidential information confidential, not to use it for any purpose other than performing this Agreement, and not to disclose to any third party any Dami confidential information that you know. Any suggestions, information, ideas, or feedback you provide to us regarding any Dami software or services, including but not limited to report documents of any errors discovered while using the software or related services (collectively, "Feedback"), shall belong to the company. You agree to assign to Dami, free of charge, all rights in the "Feedback" worldwide, including but not limited to ownership, interests, and related intellectual property rights, and agree to assist us in perfecting and exercising such rights.
8. Disclaimer
We recommend that you regularly back up your data. You shall always be responsible for mitigating losses. This software is not fault-tolerant and is not designed or intended for use in any hazardous environment requiring fail-safe performance or operation. Dami does not warrant that the website or products containing the services will be error‑free or uninterrupted, nor does it promise that the website, services, or servers are free of any harmful components. Dami makes no representation or warranty that the services provided are accurate, complete, or useful. Dami does not warrant that your use of the website or services is lawful in any particular jurisdiction, and we expressly disclaim any such warranty.
We will not become involved in disputes between users or between users and any third party relating to the use of the services. When you use the services, you undertake to hold Dami harmless from any claims or demands (whether known or unknown, suspected or unsuspected, disclosed or undisclosed) related to such disputes and services. You will bear sole responsibility for any results arising from your use of the Dami website or services, and you are fully liable for any damages or losses caused to any party as a result of your actions.
Any user who uses, tests, or evaluates Dami assumes all risk with respect to the quality and performance of Dami. We are not liable for damages of any kind, including but not limited to direct or indirect damages arising from the use, performance, or delivery of Dami, even if Dami has been advised of the existence or possibility of such damages.
Certain countries (regions) do not allow limitations or exclusions of liability for incidental or consequential damages, so the above limitation or exclusion may not apply to you. In no event shall our liability exceed the purchase price you paid for Dami. The above disclaimers and limitations apply regardless of whether you accept use, evaluation, or testing of Dami.
9. Account Cancellation
How to apply for cancellation: If a user wishes to cancel a Dami account, they may locate the "Account Cancellation" entry in the Dami official website / Personal Center / Basic Information options, and submit a cancellation request following the steps prompted by the system. They may also contact our official customer service to send a cancellation request including their identity proof, account information, and reason for cancellation.
Cancellation conditions: To ensure account security and platform order, an account applying for cancellation must satisfy the following conditions: the account is in normal use status with no risk of being compromised; there are no incomplete transactions, outstanding payments, or unresolved disputes in the account; and the account is not involved in any conduct that violates platform rules or laws and regulations. If the account has any of the above pending matters, the system will prompt the user to resolve them first, and the cancellation process may continue only after such conditions are met.
Cancellation review and processing time: We will complete the review within [3] business days after receiving the user's cancellation request. After the review is approved, the account will immediately enter the cancellation process. During cancellation, we will back up and retain the data in the user's account for a retention period in accordance with applicable laws and regulations. The backup data will only be used for purposes necessary to fulfill legal obligations and possible dispute resolution, and will thereafter be deleted or anonymized in accordance with strict security standards.
Consequences of cancellation: After account cancellation is completed, the user will no longer be able to use that account to log into this platform. All personal information in the account (including but not limited to account information, connection records, order records, etc.) will be deleted or anonymized and cannot be restored. At the same time, all rights and benefits associated with the account (such as membership benefits, virtual assets, etc.) will automatically expire. Before applying for cancellation, users are advised to carefully consider and properly handle important information and related rights and benefits in the account.
Special reminder: Account cancellation is an irreversible operation. Before submitting a cancellation request, users should confirm that they fully understand the consequences of account cancellation and ensure that it meets their needs.
